  • This research article has as its objective to analyze state responsibility for judicial error in Chile and in Mexico, based on the premise that compensation for judicial error is a human right. The legislative and precedential regulation of judicial error, as well as case study, will be analyzed in order to confront them with the parameters of the Inter-American System of Human Rights, with the purpose of verifying the effectiveness, or not, of both models. © 2021.
